Terms & Conditions ANM 2023 Sponsorship

It is understood that purchasing a sponsorship will become a binding contract upon acceptance by BCND, and incorporated into this contract are the following terms, conditions, rules, and regulations. The individual purchasing sponsorship represents and warrants that he/she is authorized to execute a binding agreement on behalf of the company, and should he/she be removed from his/her position, the contracting organization is required to fulfill the obligations under this agreement.

Payment Policy

Full payment for all Conference Sponsorships is due upon booking.

Payments can be made by cheque or credit card; company cheques or bank drafts must be received by BCND, at its Vancouver office, 2238 Pine Street, Vancouver, BC V6J 5G4, no later than 72 hours following the sponsorship agreement between the company and BCND. Failure to pay an invoice by the due date may result in a loss of sponsorship or booth assignment. Shared sponsorships or booths are prohibited.

Acceptance

BCND reserves the right to exercise its sole discretion in the acceptance or refusal of sponsorship purchases. If a sponsorship is not accepted by BCND, all money paid will be returned to the applicant.

Booth Assignments

Sponsorship confirmation must be received and confirmed by BCND before space is reserved. Priority for exhibition booth assignments is based on sponsorship level, except for the Elite, Presenting, Silver, and Bronze Sponsors, and on a first-come/first-serve basis. Special consideration to booth placement of competing companies will be made but cannot be guaranteed.

Conference Badges

BCND strictly prohibits any badge sharing, splitting, or reprinting. All attendees must wear a badge for access to all ANM 2023 sessions and events. Any violation of this policy may result in immediate removal from the event and cancellation of the registration, without receiving a refund. In addition, BCND reserves the right to deny registration for future events.

Cancellations

Cancellations must be made in writing to BCND and are subject to the cancellation fees set herein.

ANM 2023 Sponsorship cancellations will be prorated through the date of cancellation. No cancellations related to conference sponsorships can be made after September 30, 2023, without penalty (see conference cancellations below).

Full cancellation of conference sponsorships, without penalty, is available until July 31, 2023. If sponsorship is canceled between August 1, 2023, and August 15, 2023, BCND will retain 50 percent of the total agreement. If sponsorship is canceled any time after August 15, 2023, BCND will retain 75 percent of the total agreement.

In the event the ANM 2023 is canceled, conference sponsorships can be deferred to the next annual conference. By written request, refunds can be available less sponsorship benefits already received and/or the direct cost of conference-branded promotional items purchased.

Deadlines

Certain items are required to be submitted to BCND to fulfill our obligations under this contract. Should items not be submitted by the deadline, in the manner in which they are requested, BCND will not be responsible for its inability to fulfill the obligations related to said deadline.

Liability

BCND assumes no liability for damages or losses arising out of acts of omission of sponsors, exhibitors, or their employees for failure to comply with the provisions of the sponsorship agreement.

The sponsor/exhibitor agrees to indemnify and hold harmless the employees and representatives from BCND and the Vancouver Convention Centre for:

· Injury, loss, or damage that may occur to the sponsor/exhibitor, or its employees or property due to fire, robbery, or accidents;

· Complaints, suits, or liabilities resulting from the negligence of the sponsor/exhibitor in connection with the sponsor’s/exhibitor’s use of exhibit space; or

· Loss, damage, or theft of goods, exhibits, or other materials owned, rented, or leased by the sponsor/exhibitor.

· From any cause whatsoever prior, during, or subsequent to the period covered by this agreement.

Sponsors/Exhibitor are liable for all damage caused by them to the exhibit facility, booth equipment, or to other sponsors’/exhibitors’ property, and agrees to indemnify and hold harmless the employees and representatives from BCND and the Vancouver Convention Centre.

Force Majeure

In case the exhibit space contracted for shall not be available for the uses herein specified due to war, acts of international or domestic terrorism, government action or order, acts of God, fire, strikes, labour disputes, or any other cause beyond BCND’s control, the sponsorship agreement shall be terminated and, in such event, the Sponsor/Exhibitor shall and does hereby waive any claims to damages or any other recovery therefore except the return of the amounts paid as sponsorship or exhibition booth rental, less the prorated share allocable to the exhibit of the actual expenses incurred by BCND in connection with the ANM 2023. Should BCND, in its sole discretion, consider it inadvisable to hold the ANM 203 and/or the trade exhibition at the time herein provided, BCND may, at its option, terminate the sponsorship agreement and return the sums paid by the Sponsor/Exhibitor for the exhibit space, and there shall be no further liability on the part of either party to the other. Upon written notice to the Sponsor/Exhibitor, BCND shall also have the right to change the date and the place where the ANM 2023 and the accompanying trade exhibition are to be held.
